Shopper alleges item in aisle at Aldi location caused him to trip

HOUSTON – A Harris County resident alleges he was injured at a grocery store because of an object that was "sticking out" in an aisle.

Francis O'Neill filed a complaint on Dec. 11 in the Harris County District Court against Aldi Inc. alleging negligence and premises liability.

According to the complaint, the plaintiff alleges that on Nov. 2, 2017, he was injured while inside defendant's store when he tripped on an item "sticking out" into the aisle. He alleges he sustained serious injuries that resulted in pain and suffering, mental anguish, disfigurement and other medical problems.

The plaintiff holds Aldi Inc. responsible because the defendant allegedly negligently permitted the dangerous condition to exist on its premises and failed to provide adequate warning of its existence.

The plaintiff requests a trial by jury and seeks monetary relief between $100,000 and $200,000. He is represented by Michael E. Pierce and Eduardo J. Garza of Pierce Skrabanek PLLC in Houston.
