Woman sues charter school for slip and fall in women's restroom

HOUSTON – A Harris County woman has filed a lawsuit against a local charter school following an alleged slip and fall incident on its premises earlier this year.

In the suit filed on Dec. 14 in the Harris County 333rd District Court, Irma Duque asserts that Cosmos Foundation, Inc., doing business as Harmony School of Fine Arts and Technology, neglected to fix a defective soap dispenser in one of its women’s restrooms.

Soap that was on the floor purportedly caused Duque to slip and fall.

“This condition was known to the defendants as it had lasted several weeks,” court documents say. “In fact, a lady responsible for cleaning the area said this happens ‘routinely.’”

Consequently, the plaintiff seeks unspecified monetary damages.

She is represented by the law firm Mestemaker & Straub in Houston.
