Tenant sues apartment property manager, contractors after 'heavy' varnish fumes seep into unit

HOUSTON – Claiming that his apartment was filled with varnish fumes, Harris County resident John Ginley has pursued legal action.

Harris County District Court records show that Ginley brought a lawsuit against Montrose Multifamily Members, LLC; The Williams Co.; and G&R Enterprise, Inc. in the 295th District Court on Dec. 13.

Court papers list Montrose as the owner of the property in which the plaintiff resided at 2301 Commonwealth St. in Houston. Montrose reportedly contracted with Williams and G&R to perform remodeling work on an apartment above Ginley’s unit.

According to the original petition, the contractors “used a heavy varnish which seeped down” into the complainant’s apartment.

“The fumes caused the plaintiff to have difficulty breathing,” the suit says.

Ginley adds that he had to be taken to the emergency room.

Consequently, he seeks unspecified monetary damages and a jury trial.

The Daspit Law Firm in Houston is representing the complainant.
