Houston man seeks judgment over alleged agreement with Seguin Chevrolet

HOUSTON – A Houston man is seeking a court's opinion regarding a confidentiality and nondisclosure agreement.

Garrick Hatfield filed a complaint on Dec. 20 in the Harris County District Court against Seguin Chevrolet Inc. citing the Declaratory Judgment Act.

According to the complaint, the plaintiff alleges that on Dec. 3, 2018, he received a letter from defendant's lawyer accusing him of breaching a confidentiality and nondisclosure agreement and demanded he pay $50,000 in liquidated damages. The plaintiff alleges the purported contract sent by the lawyer was not signed by the defendant.

The plaintiff alleges he and the defendant entered into a separate written agreement that was actually signed by both parties that was different than the unsigned agreement.

The plaintiff alleges there exists serious and unresolved questions about his liability to the defendant, if at all.

The plaintiff asks that the court enter judgment that the purported agreement is not enforceable because it was not signed by both parties and if it is enforceable, that the liquidated damage provision is an unenforceable penalty.
