SHERMAN – Two consumers residing in Little Elm allege they were denied housing because of inaccurate information listed on a background screening report.

John and Jill Hastings filed a complaint on Dec. 21 in the Sherman Division of the Eastern District of Texas against RealPage Inc. alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiffs allege that on Oct. 10, 2018, their application for housing at Waterford at Spencer Oaks was denied because of a background screening report provided by the defendant that erroneously stated they had an eviction. The plaintiffs allege they have never been evicted and the information is inaccurate.

The plaintiffs hold RealPage Inc. responsible because the defendant allegedly failed to take any steps to verify the accuracy of the information in their report.

The plaintiffs seek actual and statutory damages, punitive damages, attorneys’ fees and costs and such other and further relief as may be just and proper. They are represented by Jody B. Burton of Lemberg Law LLC in Wilton, Connecticut.
