Dollar Tree Stores shopper alleges spilled soft drink at Houston store caused fall

HOUSTON – A Harris County resident alleges she was injured at a Houston store because of a spilled soft drink.

Maria Delia Garcia filed a complaint on Dec. 21 in the Harris County District Court against Dollar Tree Stores Inc. alleging premises liability.

According to the complaint, the plaintiff alleges that on Jan. 14, 2017, she was an invitee at defendant's store in Houston when slipped and fell because of a spilled soft drink on the floor and was injured.

The plaintiff holds Dollar Tree Stores Inc. responsible because despite allegedly having knowledge of the dangerous condition, defendant's employees allegedly neither corrected it nor to warn invitees about it.

The plaintiff seeks monetary relief of more than $100,000 but less than $200,000 and such other and further relief to which she may be justly entitled. She is represented by David K. Mestemaker, Norman Straub and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
