Sunbelt Rentals alleges it is owed more than $170,000 for equipment rental

HOUSTON – A rental company alleges two pieces of equipment were damaged while they were rented by a Harris County man.

Sunbelt Rentals filed a complaint on Dec. 26 in the Harris County District Court against Francisco Herrera alleging breach of contract.

According to the complaint, the plaintiff alleges that in August 2018, the parties entered into a rental agreement whereby defendant agreed to pay plaintiff for the rental of two John Deere Crawler Dozers. The plaintiff alleges the defendant failed to return the equipment and that they were damaged to the point of being a total loss while in the defendant's possession.

After allowing of all lawful offsets, payments and credits, the balance of $170,877.75 allegedly remains due and unpaid. 

The plaintiff seeks judgment against the defendant in the amount of $170,877.75, plus interest, costs, attorney's fees and such other and further relief to which it may be justly entitled. It is represented by Monica Schultz Orlando of Orlando & Orlando LLP in Houston.
