Consumer alleges Audit Systems continued to call him after he requested it to stop

SHERMAN – A Denton County consumer alleges a debt collector harassed him with calls.

Aaron C. Benson filed a complaint on Dec. 28 in the Sherman District of the Eastern District of Texas against Audit Systems Inc. alleging violation of the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in the fall of 2018, he received calls to his cellular phone from the defendant seeking to collect on an alleged debt. He alleges he told the defendant's representative to stop calling him but the defendant continues to call. He claims he has been harassed by the defendant's alleged actions.

The plaintiff holds Audit Systems Inc. responsible because the defendant allegedly violated the FDCPA when it continued to call him after his requests to stop and violated the TCPA by using an automatic telephone dialing system.

The plaintiff seeks statutory damages of $1,000, actual damages, costs, attorney fees and any other relief as the court deems just and appropriate. He is represented by Nathan C. Volheim and Taxiarchis Hatzidimitriadis of Sulaiman Law Group LTD in Lombard, Illinois.
