GALVESTON – A Galveston consumer alleges a debt collector invaded his privacy with its calls and text messages.
Chris Rempfer filed a complaint on Dec. 28 in the Galveston Division of the Southern District of Texas against eMoneyUSA Holdings LLC alleging that the debt collector violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff obtained a short-term installment loan from the defendant in September 2018 and defaulted on it. The suit states the defendant began calling him in an attempt to collect the debt and on Nov. 13, 2018, the plaintiff told the defendant to stop contacting him. He alleges the defendant continued to call and text him and has invaded his privacy.
The plaintiff holds eMoneyUSA Holdings LLC responsible the defendant allegedly used an automatic telephone dialing system to call and/or text him without his consent.
The plaintiff requests a trial by jury and seeks an order enjoining defendant from placing any further calls to his cellular telephone and award of statutory damages of at least $500 and treble damages of up to $1,500 for each and every violation and such other relief as the court deems just and proper.
