Mother files suit over negligence allegations against North Houston Birth Center, midwife over child's death

HOUSTON – A Harris County woman is seeking damages from a certified nurse midwife and a birth center over the death of her infant.

Shantoria Isaac, individually and as representative of the estate of Chaize Dean Reese-Edwards, deceased minor filed a complaint on Dec. 31 in the Harris County District Court against North Houston Birth Center LLC and Kathleen Vande Giessen, CNM alleging negligence.

According to the complaint, on Jan. 3, 2017, Isaac gave birth to Reese-Edwards at North Houston Birth Center. On Jan. 5, 2017, the suit states Reese-Edwards died from worsening metabolic and lactic acidosis with neonatal hypoxia and hypotension. 

The plaintiff holds North Houston Birth Center LLC and Vande Giessen responsible because the defendants allegedly failed to properly monitor and treat plaintiff's and decedent's conditions and failed to provide the medical and/or nursing care reasonably required.

The plaintiff requests a trial by jury and seeks actual damages, with interest, costs and such other and further relief to which she may be justly entitled. She is represented by L. Todd Kelly and Nicholas P. Merz of The Carlson Law Firm PC in Austin.
