Huntington National Bank, Endpoint Resolution Services have wrong number, consumer alleges

HOUSTON – A consumer residing in The Woodlands alleges a bank and a debt collector called her cellphone to collect a debt owed by a person she does not know.

Marie Spezzano filed a complaint on Jan. 2 in the U.S. District Court for the Southern District of Texas against Huntington National Bank and Endpoint Resolution Services LLC alleging that they violated the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that two years ago, she began receiving calls to her cellular telephone from Huntington in its attempt to collect a debt that is owed by a third party she does not know or associate with. She alleges she informed Huntington that she was not the party they were attempting to reach and to stop calling her.

The suit states Huntington later retained debt collector Endpoint, who began calling her in June 2018 to collect on the same account.

The plaintiff holds Huntington National Bank and Endpoint Resolution Services LLC responsible because the defendants allegedly made calls using an automatic telephone dialing system or an artificial or prerecorded voice without her prior express consent.

The plaintiff requests a trial by jury and seeks actual and treble damages, plus interest, attorneys’ fees, costs and expenses and such other and further relief deemed just and proper. She is represented by Aaron D. Radbil of Greenwald Davidson Radbil PLLC in Austin.
