Couple claims home renovation project rife with defects

GALVESTON – A Harris County couple is suing a locally-based home builder over a reportedly failed renovation job to their residence, Galveston County District Court records show.

In a lawsuit filed against Gary Johnson and Johnson Homes, Inc. on Jan. 4 in the Galveston County 10th District Court, Ronald and Dixie Messner claim that they discovered defects in connection with the defendants’ work.

“The Messners identified defects in construction that include deficiencies in electrical work, inadequate insulation, improper HVAC design and equipment, poor quality and workmanship in cabinetry, and improper installation of flooring which has resulted in mold infestation throughout the home which has required mold remediation and has required the removal and replacement of the floor, subfloor, and insulation,” the suit says.

The respondents are also accused of overbilling the plaintiffs.

Consequently, the Messners seek unspecified monetary damages and a jury trial.

They are represented by the law firm Simpson, Beeton, Shabot & McConnell, LLC in Galveston.
