HOUSTON – A Starr County resident alleges he was injured while working and his employer failed to provide him maintenance and cure.

Delfino Rios filed a complaint on Jan. 3 in the Harris County District Court against Great Lakes Dredge & Dock Co. LLC alleging pain and mental anguish.

According to the complaint, the plaintiff alleges that on Oct. 16, 2016, he was aboard defendant's vessel working on the Crane 63 barge when a pipe fell on top of him and caused injuries to his shoulder, neck, back and arms.

The plaintiff also alleges that he has not reached maximum medical improvement and that the defendant's duty to provide him with the benefits of maintenance and cure continues. He alleges the defendant has denied him payments and/or unreasonably delayed payments.

The plaintiff requests a trial by jury and seeks damages of more than $1 million, with interest, costs and such other and further relief to which he may be justly entitled. He is represented by Anthony G. Buzbee and Christopher J. Leavitt of The Buzbee Law Firm in Houston.
