Homeowner alleges debris left by Lowe's Home Centers, others on property caused fall

HOUSTON – A Harris County homeowner alleges debris left on her property by workers caused her to trip and fall.

Livia Mijares filed a complaint on Jan. 7 in the Harris County District Court against Lowe's Home Centers LLC, et al. alleging negligence.

According to the complaint, the plaintiff contracted the defendants to do some projects around her home. She alleges that on Jan 9, 2017, she was attempting to walk around her house when she tripped and fell. She alleges the defendants left trash and debris in a manner as to cause a hazard, and she was not able to clean up the building materials on her own due to her age and physical stature.

The plaintiff seeks actual and special damages, costs, expenses, interest and all other relief to which she may be entitled. She is represented by David K. Mestemaker, Norman Straub and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
