Asian restaurant alleges energy plan failed to yield savings, pursues legal action

HOUSTON – A local Asian restaurant has filed a state district lawsuit alleging it was tricked into signing up for a deceptive energy plan.

According to recent Harris County District Court records, Kim Son Restaurant, Inc. brought the suit against Constellation NewEnergy, Inc. and LEDi2, Inc. on Jan. 10 in the 113th District Court.

Court filings assert that the defendants misrepresented to Kim Son the eatery “would achieve conservatively a savings of approximately $126,000 per year” if the plaintiff enrolled in Constellation’s Efficient Made Easy Plan and switched from conventional lighting to LED lighting.

“Kim Son received little to no cost savings and for certain properties its energy costs were higher with the defendants’ LED lights,” the suit says. “The LED lights were not quality warranted.”

Consequently, the plaintiff seeks unspecified monetary damages.

It is represented by the law firm Mai and Na PLLC in Houston.
