Pizzeria chain accused of deducting employees' tips

HOUSTON – New York Pizzeria, Inc. has been implicated in a former employee’s federal class action lawsuit for unlawful deductions from tips, recent Houston Division of the Southern District of Texas records show.

The worker, Chiarra Ettorre, filed the 15-page suit against the local restaurant chain on behalf of herself and other workers on Jan. 23, asserting the defendant violated its usage of a tip credit by retaining her and similarly situated individuals’ tips for its own purposes.

Employed by the eatery from March 2015 to December 2018, Ettorre recalls an instance in which the respondent docked a supposed linen cleaning fee from her wages. The deduction occurred on a consistent basis throughout the complainant’s employment, the complaint says.

The defendant allegedly “has employed individuals who performed similar job duties under a similar payment scheme as used to compensate the plaintiff.”

Unspecified monetary damages and a jury trial are consequently sought.
