Restaurant faces legal action after employer holds, drops intoxicated customer to the floor

HOUSTON – A southeast Houston restaurant’s attempt to assist an intoxicated diner more than a year ago has resulted in a personal injury lawsuit against the business, recent Harris County District Court records show.

Maleny Hernandez brought the 7-page suit against Chilos Seafood Restaurant in the Harris County 129th District Court on Jan. 23, claiming that an employee of the defendant tried to help her as she was struggling to sit on a counter at the bar only to drop her on the floor. The plaintiff reportedly consumed many alcoholic beverages at the time of the subject incident.

Hernandez recalls slipping into unconsciousness prior to being transported to the emergency room. According to the complainant, she suffered various head injuries, including, but not limited to: traumatic injury to the head, post traumatic headache, and a post-concussion syndrome.

Jose M. Herrera, the eatery’s owner, is listed as a co-defendant in the litigation.

Consequently, Hernandez seeks unspecified monetary damages and a jury trial.

She is represented by Olufemi Ogunjumelo of the Mayday Law Office, PLLC in Houston.
