SHERMAN – A Kentucky resident alleges a Carrolton-based collection agency keeps contacting him for an alleged debt he does not owe.

Taylour Butler filed a complaint on Jan. 24 in the Sherman District of the Eastern District of Texas against Credit Management LP alleging that the debt collector repeatedly violated the Fair Debt Collection Practices Act.

According to the complaint, the defendant contacted the plaintiff regarding an alleged debt within the last year. The plaintiff alleges he is not responsible for the debt and is a student residing at the address listed on the account for the debt. He alleges he notified the defendant that he is not responsible for the debt and does not have an account with the defendant, but the defendant continues to call him to collect it.

The plaintiff holds Credit Management LP responsible because the defendant allegedly used false, deceptive and misleading representation in connection with the collection of the alleged debt.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages of $1,000, costs of litigation, attorney’s fees and such other and further relief as may be just and proper. He is represented by Jody B. Burton of Lemberg Law LLC in Wilton, Connecticut.
