State rep. files Harvey suit against Farmers, Daly & Black representing her

HOUSTON – A member of the Texas House of Representatives is suing an insurance company for not paying her what she believes was owed on a Hurricane Harvey claim. 

Seeking up to $200,000 in damages, Shawn Thierry, a Democrat representing District 146, filed suit against Texas Farmers Insurance on Jan. 29 in Harris County District Court.

According to the lawsuit, Thierry’s Houston home was damaged during Harvey back in August 2017. The adjuster assigned to the claim allegedly conducted a substandard investigation and failed to include all of the damages.

“This unreasonable investigation led to the underpayment of Plaintiff’s claim,” the suit alleges. “Moreover, Farmers performed an outcome-oriented investigation of Plaintiff’s claim, which resulted in a biased, unfair and inequitable evaluation of Plaintiff’s losses…”

Thierry, a trial lawyer out of Houston, is accusing Farmers of breach of contract.

She is represented by Daly & Black, a Houston law firm specializing in insurance litigation.

Thierry is not the only member of the Texas Legislature connected to Daly & Black.

In November, a video surfaced of firm founder Ricky Daly boasting about involving Rep. Todd Hunter in litigation against the Texas Windstorm Insurance Association.
