Alleged assault at gym focus of member's lawsuit

HOUSTON – The law firm Fernelius Simon PLLC in Houston has filed a lawsuit against a Southern California-based gym chain on behalf of a Texas man who claims that he was physically assaulted last month at one of its local facilities, recent Harris County District Court records show.

In the complaint filed on Jan. 29 in the 151st District Court, Brian Joseph Green faults Fitness International, LLC, doing business as LA Fitness, for allowing the Dec. 12, 2018 incident in question at the gym located at 195 Yale St. to occur.

Green alleges that an individual named Phillip Ray Kent and two other men knocked him to the ground and repeatedly punched and kicked him. The unidentified assailants were not members of the gym, the suit says.

According to the plaintiff, LA Fitness “violated its own policies” by allowing them access onto the premises. He insinuates that an employee witnessed the attack but did nothing to stop it.

Kent is listed in the suit as a co-defendant.

Consequently, Green seeks unspecified monetary damages and a jury trial.
