HOUSTON – A forklift operator is seeking damages from a trucking company over allegations its negligence caused the forklift to fall.

Rodolfo Vasquez filed a complaint on Jan. 28 in the Harris County District Court against RKL Transport alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 30, 2017, he was operating a forklift at a Harris County warehouse to remove merchandise from defendant's trailer. He alleges the defendant's driver pulled away the trailer from the warehouse dock while he was exiting it with the forklift, causing the forklift to fall. He alleges he has suffered medical expenses, loss of earnings, pain and suffering and loss of enjoyment of life.

The plaintiff holds RKL Transport responsible because the defendant allegedly failed to institute proper and effective safety policies, procedures and programs for screening, training and supervision.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by J. Moses Cedillos of Cedillos Law Firm PLLC in Houston.
