Former delivery driver alleges he is owed unpaid overtime compensation from Hafiz Bros., others

HOUSTON – A Houston man alleges his former employers failed to pay him the appropriate rate for overtime work.

Arsenio Padilla filed a complaint on Jan. 29 in the Houston Division of the Southern District of Texas against Hafiz Bros. Inc., et al. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants, who own and operate a Houston-area grocery store, for four years as a butcher and deliver driver. He alleges that he regularly worked more than 40 hours per week and was not compensated at a rate of one-and-one-half times his regular rate of pay for the additional hours worked in violation of the FLSA.

The plaintiff seeks judgment against defendants, jointly and severally, for unpaid overtime compensation; liquidated damages; attorneys’ fees; costs; expenses; interest and such other and further relief as may be allowed by law. He is represented by Mark Siurek of Warren & Siurek LLP in Houston.
