Diaz and Associates allegedly unlawfully spoke to man's co-worker in attempt to collect alleged debt

HOUSTON – A consumer alleges a debt collector called his workplace and spoke about his alleged debt with a co-worker.

Anhtuan H. Pham filed a complaint on Feb. 1 in the Houston Division of the Southern District of Texas against Diaz and Associates Inc. alleging that the California corporation violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.

According to the complaint, the plaintiff alleges that the defendant contacted his workplace and spoke to a co-worker in an attempt to collect an alleged debt from him. He alleges the defendant disclosed personal and sensitive information to his co-worker and also stated that it would take him to court if he did not contact it immediately.

The plaintiff alleges when he contacted the defendant, it "threatened to send an officer" to serve him court documents if he did not make an immediate payment.

The plaintiff holds Diaz and Associates Inc. responsible because the defendant allegedly violated the FDCPA when it contacted and communicated with a third party regarding the alleged debt.

The plaintiff requests a trial by jury and seeks actual and punitive damages, costs, attorney fees and any other relief as the court deems just and proper. He is represented by Alexander J. Taylor, Marwan R. Daher and Omar T. Sulaiman, of Sulaiman Law Group LTD in Lombard, Illinois.
