Santa Fe property buyer alleges sellers failed to transfer title

GALVESTON – A Galveston County resident alleges the sellers of a property he purchased failed to transfer the title after he made his final payment.

Kenneth Briggs filed a complaint on Feb. 1 in the Galveston County District Court against Robert Trathen and Margaret Trathen alleging violations of the Texas Property Code.

According to the complaint, the plaintiff alleges that on March 3, 2002, he entered into an executory contract for the purchase of the property commonly known as 15930-1 Pine Street in Santa Fe with the defendants. The plaintiff alleges he continued to make all payments until the final payment on or about April 1, 2015, but the defendants failed to convey the property to him.

The plaintiff holds Robert Trathen and Margaret Trathen responsible because the defendants allegedly failed to survey the property, did not provide a seller's disclosure and failed to transfer the recorded, legal title of the property to him within 30 days of receiving the final payment.

The plaintiff seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by W. Rhys O’Farrell and Russell F. Plackemeier of Lyons & Plackemeier PLLC in Texas City.
