HOUSTON – A forklift driver is suing FedEx and its driver over allegations he was injured when a truck moved away from the dock without notice and caused the forklift to fall.

William Coreas filed a complaint on Feb. 5 in the Harris County District Court against Federal Express Corp., FedEx Freight Inc. and Ben Richardson alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Sept. 20, 2017, he was working as a forklift driver for Sigma Corp. The suit states the plaintiff was loading pallets of pipes into bed/trailer of the defendants' truck when the truck began to move away from the dock without notice, which caused his forklift to fall down between the gap of the dock and the bed/trailer of FedEx truck. The suit states Richardson was driving the truck at the time.

To avoid death, the plaintiff alleges he jumped off the forklift and in doing so, he hit his body on the concrete wall of the loading dock before falling on the concrete surface. He alleges he sustained serious injuries to his back, neck, right shoulder and arm.

The plaintiff holds Federal Express Corp., FedEx Freight Inc. and Richardson responsible because defendant Richardson allegedly failed to secure the vehicle at the subject loading dock and failed to exercise caution before moving the truck away from the loading dock.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief to which he may be justly entitled. He is represented by Micky N. Das of Tyler & Das in Houston.
