Los Cucos Mexican Cafe patron alleges water on restroom floor caused fall, broken arm

HOUSTON – A Houston woman alleges a fall at a restaurant in the city caused a broken arm.

Maria Hernandez filed a complaint on Feb. 6 in the Harris County District Court against Los Cucos Mexican Cafe Corp. alleging negligence.

According to the complaint, the plaintiff alleges she was at the defendant's premises on Westheimer Road in Houston to attend a surprise birthday party when she slipped on water on the restroom floor and fell. She also alleges there was insufficient lighting in the restroom.

The plaintiff holds Los Cucos Mexican Cafe Corp. responsible because the defendant allegedly failed to provide adequate lighting in the restroom, failed to remove the slippery condition of the floor and failed to give adequate warning of the unsafe condition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other and further relief to which she may be justly entitled at law and in equity. She is represented by Olufemi Ogunjumelo of Mayday Law Office in Houston.
