Former Flexpipe Systems employee files age discrimination suit over termination

HOUSTON – A Houston man has filed a complaint against his former employer over allegations his age was a factor in his termination.

Michael Smith filed a complaint on Feb. 6 in the Harris County District Court against Flexpipe Systems (US) LLC alleging that the former employer violated the Age Discrimination in Employment Act and the Texas Commission on Human Rights Act.

According to the complaint, the plaintiff is in his 60s and he alleges that his younger boss discriminated against him because of his age. He alleges he complained about the conduct to the defendant's human resources department and was terminated on Feb. 7, 2017, in retaliation and without any explanation.

He alleges he has looked for a comparable job, but has unable to secure one. 

The plaintiff holds Flexpipe Systems US LLC responsible because the defendant allegedly retaliated against him for complaining discriminatory practices and terminated him and replaced him with a younger employee.

The plaintiff requests a trial by jury and seeks monetary relief of more than $50,000, plus punitive damages, interest, attorney's fees, costs and all other relief to which he is entitled. He is represented by Mark J. Oberti and Edwin Sullivan of Oberti Sullivan LLP in Houston.
