Curtain call: attorney nonsuits Hamilton ticket suit

HOUSTON – A state district lawsuit pitting a local attorney against Ticketmaster was recently nonsuited.

According to Harris County District Court records, Joshua P. Davis submitted a notice of nonsuit on Feb. 5 into the suit he filed last month over what he claimed was a “mistaken purchase” of seats to the popular Broadway musical Hamilton.

As previously reported in The Southeast Texas Record, Davis’s complaint demanded Ticketmaster issue him a refund for the $2,325.20 he “accidentally” spent for what was supposed to be a birthday present for his daughter.

The plaintiff attributed the failed transaction to a glitch on Ticketmaster’s Web site.

His notice says that he nonsuits “with prejudice to re-filing same.” Court records indicate a “Hold for Judgment” status for the suit.

Ticketmaster did not formally respond to the litigation.
