Praxair worker alleges berm constructed by Trey Industries caused fall

GALVESTON – A Santa Fe man alleges he was caused to fall because a berm was constructed too close to a fixed ladder.

Frank Guerra Jr. filed a complaint on Feb. 8 in the Galveston County District Court against Trey Industries Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 27, 2018, he was working for Praxair Inc. in Texas City and on a premises constructed by the defendant. He alleges as he was dismounting a fixed ladder, he inadvertently stepped on a berm constructed by the defendant and was caused to fall.

The plaintiff holds Trey Industries Inc. responsible because the defendant allegedly failed to construct the ladder and berm in compliance with Occupational Safety and Health Administration practices, failed to warn of the condition and failed to remedy it.

The plaintiff seeks monetary relief between $100,000 and $500,000 and such other and further relief to which he may show himself justly entitled. He is represented by Kelly Forester of Matthews & Forester in League City.
