Walgreens customer alleges parking barrier that caused fall was not marked

HOUSTON – A patron of a Houston pharmacy alleges its failure to mark a parking barrier caused her to trip and hit her face on the concrete.

Leah McCurry filed a complaint on Feb. 8 in the Harris County District Court against Walgreen Co. alleging negligence and premises liability.

According to the complaint, the plaintiff alleges that on Feb. 15, 2017, she was a patron at defendant's store on San Felipe Street in Houston when she tripped over an unmarked parking barrier and fell, striking her face on the concrete. She alleges she sustained serious injuries that resulted in pain, disability, medical expenses and disfigurement because of the fall.

The plaintiff holds Walgreen Co. responsible because the defendant allegedly failed to paint and/or mark the parking barriers to make them more visible and failed to provide adequate warning of any latent defects on its premises.

The plaintiff seeks monetary relief of less than $100,000 and such other and further relief to which she may show herself justly entitled. She is represented by Randy L. Wooten of Randy L. Wooten PC in Houston.
