Son blames nursing home for mother's death from infection

GALVESTON – A Texas City nursing home has been named in a wrongful death lawsuit from the son of one of its former residents.

According to recent Galveston County District Court records, Jimmy Martinez filed the suit against Bay Oaks SNF, LLC, doing business as The Lakes at Texas City doing business as Bay Oaks Health Care Center on Feb. 13 in the Galveston County 10th District Court.

Martinez asserts in the 7-page complaint that the defendant lacked adequate fall prevention interventions which could have prevented his late mother, Judith Ruiz, from injuring her left foot in late December 2017.

Ruiz’s injury purportedly worsened and prompted the decedent to be taken to the hospital.

Diagnosed with sepsis, urinary tract infection, and infection of her foot, the original petition says, Ruiz succumbed to “enterococcus faecium sepsis” on Jan. 10, 2018.

Consequently, Martinez seeks unspecified monetary damages and a jury trial.
