Sandwich restaurant chain formally answers wrongful death suit

HOUSTON – A fast food restaurant chain that was sued earlier this year in response to a fatal shooting at one of its eateries recently answered the allegations raised by the lone survivor.

Harris County District Court records show that KK Sub, LLC; Subway Restaurants LLC; and Subway Holdings LLC each submitted formal responses to Hilda Vasquez’s lawsuit.

As previously reported in The Southeast Texas Record, Vasquez asserts a lack of security at the defendants’ business located at 3933 Broadway St. allowed armed assailants to enter and rob her and her late son, Javier Flores, on Feb. 22.

The plaintiff further states that Flores attempted to save her when he was shot and killed.

The respondents deny responsibility for the subject incident, their answers requesting the 269th District Court to designate the “unknown criminals” as responsible third parties.

Richard M. Grimes of the law firm Grimes & Fertitta, P.C. in Houston is representing KK Sub while Lori Pritchett of the Law Offices of Kilpatrick & Deas, also in Houston, serves as the lead counsel for Subway.
