Customer alleges Lexus dealer lied about car's features

GALVESTON—A Galveston County woman is suing a Lexus dealer, alleging she was sold a vehicle that did not include features the dealer said it did.

Carol Zendeh Del filed a complaint Feb. 25 in Galveston County District Court against Fred Forshey and McCall-TL Inc., doing business as Lexus of Clear Lake, alleging negligent misrepresentation and economical damages as well as common law fraud.

According to the complaint, Zendeh Del was only interested in looking at vehicles with certain safety ratings. The suit says Forshey, a Lexus salesman, encouraged her to consider a 2018 Lexus GX 460 and alleged that the make was the highest ranked vehicle for safety in U.S. News and World Report and Consumer Reports. 

The suit says Forshey also alleged that there were safety features on the car that did not exits.

Zendeh Del seeks trial by jury, damages between $100,000 and $200,000, attorney fees and court costs. She is represented by attorney Jonathan Zendeh Del of Zendeh Del & Associates PLLC in Galveston.
