Railroad worker alleges negligence led to injuries

MARSHALL —A railyard worker is suing a railway company, alleging negligence caused his workplace injury.

Gregory Lebrun filed a complaint March 5 in Marshall Division of the Eastern District  of Texas against The Kansas City Southern Railway Company, alleging violation of the federal employers' liability act.

According to the complaint, on March 10, 2016 Lebrun was working for the defendant as a car man in the Deramus Yard. The suit states Lebrun had to wade through water that was opaque, causing him to lose his footing and fall, striking an underwater rail and sustaining injuries to his body and expenses for medical treatment.

Lebrun seeks all damages, pre- and post-judgment interest, attorney fees and court costs. He is represented by attorneys Mike C. Miller of the Law Office of Mike C. Miller in Marshall, and by Jonathan Winocour of Winocour Law in Dallas.
