Customers allege construction company performed unacceptable work

HOUSTON — Two individuals are suing a Houston construction company, alleing the work was not done to expected standards and repairs were never made.

Melissa Engelhardt and Kelly Walker filed a complaint March 15 in Harris County District Court against Ricardo Dewitt, individually and doing business as Dewitt General Construction and Remodeling, alleging breach of contract, negligence, negligent misrepresentation and fraud. 

The suit says in June 2018 Engelhardt and Dewitt began speaking about the possibility of remodeling Engelhardt's home at 2903 Manila Lane, Houston. The defendant allegedly made certain representations about his quality of work, convincing Engelhardt to enter into a contract June 2, 2018, when Dewitt received the first deposit of $5,000. 

The suit alleges Dewitt received additional payments on June 28, 2018, of $7,000 and on July 17 of $4,100. The plaintiffs allege the defendant said workers would be coming to the house, but they were never there when they said they would be. 

Engelhardt says she became aware that the work being done at her Houston house was not up to the standard that the contract promised. The suit says when Engelhardt confronted the defendant about the errors, DeWitt General Construction failed to make the necessary repairs.

Engelhardt and Walker seek a jury trial, compensatory damages between $25,000 and $120,000, $100,000 in money damages, $20,000 for mental anguish, $100,000 in punitive damages, attorney fees and court costs and all other proper relief. They are represented by attorney Steven Engelhardt of Engelhardt Law PLLC in Houston.
