Employee alleges Marathon Oil failed to pay for overtime work

GALVESTON — A Louisiana man is suing Marathon Oil, alleging he was not paid for overtime work.

Jimmy Hebert of Prairieville, Louisiana, filed a complaint March 13 in the Galveston Division of the Southern District of Texas against Marathon Oil Company and Cudd Pressure Control Inc., doing business as Energy Personnel International, alleging violation of the Fair Labor Standards Act.

The suit allege Hebert was retained by Marathon on March 7, 2018, to work on a fracking operations in New Mexico. until Jan. 10, 2019, when the plaintiff was terminated. The plaintiff says he was not paid his overtime wages when he worked more than 40 hours per week as required by FLSA. On average, Hebert says he worked 87.5 hours a week. 

Hebert seeks trial by jury, unpaid overtime compensation, liquidated damages, attorney fees and all just relief. He is represented by attorneys Scott Newar of Houston and by Charles Herd of Herd Law Firm in Houston.
