Worker alleges employer routinely failed to pay overtime

HOUSTON — A Comal County man is suing his employer, alleging failure to pay him for overtime work.

Louis Sheffield, individually and on behalf of all other similarly situated, filed a class action complaint March 20 in the Houston Division of the Southern District of Texas against Stewart Builder Inc. alleging violation of the Fair Labor Standards Act. 

The suit says Sheffield worked for Stewart Builder as a pump operator from July 2017 until January 2019 when he was promoted to supervisor  The lawsuit alleges Sheffield was terminated in March 2019. 

Sheffield alleges he regularly worked in excess of 40 hours a week. He said he was paid an annual bonus regularly but he never agreed that the salary paid was sufficient to cover the hours that he worked. The defendant allegedly took no consideration of the plaintiff's overtime, in violation of the FLSA.

Sheffield seeks unpaid compensation, liquidated damages, court costs and attorney fees, as well as all other fit relief. He is represented by attorney Josh Sanford of Sanford Law Firm PLLC in Little Rock, Arkansas.
