Resident argues veterans housing complex responsible for assault

HOUSTON – A resident of a local veterans housing complex has taken the property to court following an alleged physical assault last month.

In a lawsuit filed against Cloudbreak Houston, LLC, doing business as Midtown Terrace Suites, on Mar. 26 in the Harris County 295th District Court, Martin Graham claims that he was taking out his trash when he was “violently” attacked by three individuals unprovoked.

The plaintiff went to the hospital following the subject incident.

According to court documents, the attack was “foreseeable from Midtown Terrace’s perspective.”

“A significant number of people live on the streets close to the property, resulting in frequent incidences of trespassing,” the original petition says. “The frequent trespassing upon the property is obvious to Midtown Terrace.”

Graham asserts that the defendant failed to prevent the frequent trespassing from occurring.

He seeks unspecified monetary damages and a jury trial.

The law firm Sullo & Sullo, LLP in Houston is representing the complainant.
