Rosenberg police sergeant alleges termination violated procedural due process

HOUSTON — A police sergeant is suing his department, alleging he was terminated in violation of procedural due process.

John Johnson filed a complaint March 27 in the Houston Division of the Southern District of Texas against Rosenberg Police Department, the city of Rosenberg, Jeremy Eder and Dallis Warren, alleging due process violation, infliction of emotional distress and violation of the 14th Amendment.

According to the complaint, Johnson was employed by the department as a police sergeant and had always done satisfactory work. The plaintiff said he was terminated April 3, 2017, after being accused of conducting active-shooter training with his unit at a movie theater. 

The suit says Johnson was fired in violation of procedural due precess, which caused damages to him emotionally and injured his reputation as a police officer.

Johnson seeks trial by jury, punitive, exemplary and economic awards, attorney fees and court costs, as well as interest. He is represented by attorneys Alexander J. Houthuijzen in Houston and Pimal A. Patel of Patel PC in Houston.
