Construction company owner alleges Houston customer owes $15,000 for completed work

GALVESTON — A construction company owner is suing a Houston client, alleging he was not paid more than $15,000 for work completed.

Larry Shelmire, jointly and severally doing business as Shelmire Construction Company, filed a complaint April 1 in Galveston County District Court against Wayne Beita, jointly and severally doing business as Custom Remodeling, alleging breach of contract and common law fraud.

According to the complaint, Shelmire and Beita entered into an agreement Nov. 8, 2018, for the demo and installation of new fences with gates at 1600 Allen Parkway, Houston for $500 per fence with materials and labor included. The suit says the total price to be paid was $14,500. 

The plaintiff alleges he has submitted invoices to Beita but the defendant has failed to pay off the current balance owed of $15,500.

Shelmire seeks trial by jury, all money owed, attorney fees, court costs and all just relief. He is represented by attorney Cris A. Rasco of Rasco Law Firm in Texas City.
