Customer alleges scrap metal yard's negligence led to broken foot

HOUSTON — A Waller County woman is suing a scrap metal yard, alleging that her foot was broken when she was struck by a piece of metal.

Julie Soliman filed a complaint April 10 in Harris County District Court against Katy Scrap Metal and Luis Antonio Fajardo, alleging gross negligence and failure to maintain the premises.

According to the complaint, Soliman was a business invitee at Katy Scrap Metal on Oct. 21, 2017. The suit says while Soliman was dropping off recyclables, employees of the defendants were throwing metal from a truck. Soliman says one piece bounced off and hit her, causing immense pain to her right foot and leg.

The suit says Soliman was transported to the emergency room at Memorial Hermann Katy Hospital where she was diagnosed with a factured foot, leading to medical expenses and mental anguish.

Soliman seeks exemplary damages, interest, trial by jury and all other just relief. She is represented by attorneys Charles H. Peckham and Mary A. Martin of Peckham Martin PLLC in Houston.
