Fort Bend County company alleges business partner tried to infringe on intellectual property

HOUSTON — A Fort Bend County company is suing a business partner, alleging he tried to infringe on intellectual property.

AQuarius Power Inc of Katy, Texas,. filed a complaint April 12 in the Harris County District Court against Jacob Seal, alleging breach of contract.

According to the complaint, AQuarius Power's president and CEO was introduced to Seal in January 2018. The suit states an agreement was reached in which Seal would pay $10 million to $14 million in exchange for 51 percent equity ownership of the plaintiff's company. 

The suit states AQuarius Power notified the defendant and explained that a formal shareholders' vote would be needed before any transaction could take place. Seal allegedly threatened legal action against AQuarius for anticipatory breach, but the plaintiff believes this was the defendant's tactic to infringe upon the intellectual property rights of the plaintiff.

AQuarius Power seeks monetary relief up to $1 million, attorney fees, declaratory judgment and all other equitable relief. It is represented by attorney Robert Musemeche of Musemeche Law PC in Webster.
