Man sues neighbors after falling through back porch

BEAUMONT – A Fannett man is suing his neighbors, claiming he fell through their back porch deck.

Seeking up to $1 million in damages, Wendell Wendling filed suit against Jeffrey and Stacey Philmon on April 10 in Jefferson County District Court.

According to the lawsuit, on Feb. 27, 2018, Jeffrey asked Wendling to go over to his house next door and lock it up. Wendling agreed and as he was exiting the backdoor he fell through the porch deck, which turned out to be rotted.

Wendling claims he injured his left leg falling through the deck.

He is contending his neighbors acted with a “conscious indifference” for his welfare and is suing them for exemplary damages.

Wendling is also suing for his past and future medical expenses, pain, mental anguish, impairment, disfigurement and loss of earnings.

Beaumont attorney John Thomas represents him.

Judge Baylor Wortham, 58th District Court, has been assigned to the case.
