Customer alleges Kroger's negligence caused fall

GALVESTON — A Galveston County woman is suing Kroger, alleging she was injured when she tripped and fell over items on the floor at the defendant's store in Friendswood.

An Luong filed a complaint April 23 in Galveston County District Court against Mark Sabatier, a store manager, and Kroger Texas LP, alleging liability and negligence.

Luong alleges she was shopping at the Kroger's at 151 N. Friendswood Drive, Friendswood, on May 3, 2017. The suit says Luong tripped and fell over shelving and components that should not have been on the floor of the store. 

As a result of the fall, the plaintiff says she sustained injuries to her right shoulder and right rotator cuff that required surgery and physical therapy, plus she suffered mental anguish and physical pain.

Luong seeks between $200,000 and $1 million, trial by jury, court costs, attorney fees and all other equitable relief. She is represented by attorneys Anthony Akins Pusch and Chi-Hung David Nguyen of Pusch & Nguyen Law Firm PLLC in Houston.
