Customer alleges car repair shop failed to fix vehicle as promised

GALVESTON — A Harris County woman is suing a Galveston County car repair shop, alleging it failed to repair a vehicle as it said it would.

Kathy Wagner filed a complaint May 23 in Galveston County District Court against Clear Lake Body Shop LLC, doing business as Rockin' R Collision, and Charlie Ruhl, individually and doing business as Clear Lake Body Shop and doing business as Rockin' R Collision, alleging breach of implied and express warranty and deceptive and misleading acts.

According to the complaint in May 2017, Wagner took her 2011 GMC Sierra SLE pickup to Rockin' R Collison for repairs. The defendant told Wagner that it could make the repairs, and after about seven weeks, the defendant began to send the vehicle to other vendors for repairs, the suit says. 

The lawsuit states Rockin R' Collion then falsely represented to Wagner that the truck had been repaired on Aug. 30, 2017. The plaintiff says the vehicle has not been repaired properly and, as such, the defendant has failed in its representations. The defendant, the suit says. has also failed to remedy their errors.

Wagner seeks relief for expenses and repair costs of $3,500, damages for the loss of use of the pickup for $2,500, trial by jury, attorney fees and all other just relief. She is represented by attorney Clifford L. Harrison of Munsch, Hardt, Kopf & Harr PC in Houston.
