Two roofing company employees allege unfair termination

GALVESTON —Two Galveston County women are suing a roofing business, alleging they were unfairly terminated and not paid for the work they completed.

Michelle Garcia and Rachel Louviere filed a complaint May 22 in the Galveston Division of the Southern District of Texas against Morgan Roofing LLC and David F. Morgan, alleging violation of the Fair Labor Standards Act and breach of contract.

According to the complaint Louviere and Garcia, were employed by Morgan Roofing from Aug. 17, 2018-April 17, 2019. The suit says they averaged more than 40 hours a week but were not paid for the extra hours they worked as required by FLSA. 

The Department of Labor began to investigate the defendant, the suit alleges, and the plaintiffs cooperated with the investigation, but Garcia and Louviere were terminated April 17. 

Morgan Roofing also allgedly failed to provide Garcia and Louviere with compensation for goods the plaintiffs had purchased while employed by the defendant. The lawsuit alleges the defendant has failed to pay the plaintiffs for the work they completed. Louviere says she is owed $239,200 and Garcia seeks $187,200.

The plaintiffs seek trial by jury, attorney fees, liquidated damages and interest. They are represented by attorneys Lionel Martin and Melissa Garcia-Martin of Garcia-Martin & Martin PC in Sugar Land.
