HOUSTON — A Harris County man is suing his employer, alleging he was routinely underpaid for the hours that he worked.

Asi Mustafa filed a complaint May 28 in the Houston Division of the Southern District of Texas against BNS Management Inc., Pushp Kumar Jain and Sunita Jain, alleging violation of wage and overtime pay provisions and violation of the Fair Labor Standards Act (FLSA).

Mustafa says he regularly worked overtime hours as a store clerk for BNS Management's Exxon Food Mart Deli in Channelview. However, the defendants allegedly failed to pay the plaintiff at the pay rate he was owed for hours worked beyond 40 per week as required by FLSA. Instead, the plaintiff says, he was paid only for the first 40 hours worked each week.

Mustafa seeks trial by jury, attorney' fees, costs of litigation, and all other equitable relief. He is represented by attorney Salar Ali Ahmed in Houston.
