Man sues Home Depot after cart dolly rolls over foot

BEAUMONT – Home Depot was recently hit with a lawsuit alleging a man was injured when a loaded cart dolly rolled over his foot.

Seeking no more than $100,000 in damages, Mario Delgadillo filed the suit June 7 in Jefferson County District Court.

According to the lawsuit, on April 9 Delgadillo was shopping at the Beaumont Home Depot. He was pulling a loaded cart dolly when “suddenly and without warning” an employee grabbed the cart and caused it to roll over his foot.

Delgadillo claims he slipped and fell and landed on his back because of the incident.  

He is accusing Home Depot of negligently failing to safeguard him and seeks damages for his alleged medical expenses, mental anguish, impairment, disfigurement and lost wages.

The Daspit Law Firm in Houston represents him.

Judge Kent Walston, 58th District Court, is assigned to the case.
