Drywall company alleges former employee stole clients

HOUSTON — A Harris County drywall company is suing a former employee, alleging he stole clients after leaving the employ of the plaintiff.

Chase Drywall filed a complaint June 13 in Harris County District Court against Matt Kozak, alleging breach of fiduciary duty and tortious interference.

According to the complaint, Kozak became a salesman for Chase Drywall in April 2002. The suit alleges Kozak was taught operations and the bidding process and had access to use the proposal program developed by the plaintiff. 

The suit allege the defendant was promoted a number of times until he became president. The defendant allegedly requested a meeting with Chase Drywall on March 16, and informed the plaintiff he was taking time off to spend with family. The complaint alleges Kozak instead proceeded to open his own business, stealing customers from the plaintiff and discrediting the plaintiff's reputation.

Chase Drywall seeks relief of more $1 million, exemplary damages, attorney fees, interest, court costs and other equitable relief. It is represented by attonrey Chuck Portz of Portz Portz & Peña in Houston.
