Crosby couple alleges construction company built home in negligent manner

HOUSTON — A Crosby couple is suing a construction company, alleging their home was built in a negligent manner and necessary repairs were not made.

Aurelio Sanchez Jr. & Kelly Sanabria filed a complaint June 17 in Harris County District Court against Joe's Construction LLC and Jose A. Perez, individually, alleging breach of contract, negligence, fraud and Deceptive Trade Practices Act violations.

The plaintiffs own a property at 4543 Kenning Road, Crosby, the suit alleges, and in 2016 they contracted Joe's Construction to construct their custom home. The defendants allegedly represented to the plaintiffs that they had numerous longstanding business relationships with well-qualified subcontractors that they could use if necessary. The defendants also allegedly told Sanchez and Sanabria that if there were any issues with the completed work, the plaintiffs would be able to have the issues corrected. 

The complaint alleges the home was completed in December 2016 but the plaintiffs began to notice a number of issues with the home, including plumbing, ceiling beams that were sagging, cracks on the exterior and electrical devices that were not working. The plaintiffs said they hired an inspection company to examine the work, which confirmed the plaintiffs' fears about the property. The plaintiffs said they contacted Joe's Construction to seek out repairs.

The suit alleges the defendants initially agreed to do the repairs but have since refused to do so unless the plaintiffs pay them more.

Sanchez and Sanabria seek monetary relief between $100,000 and $200,000, actual damages, attorney fees, court costs, interest and all other just relief. They are represented by attorney Christopher Stanley of the Law Office of Christopher S. Stanley PLLC in Crosby.
